3. Terms of Product Purchase

The Agreement

In addition to the Terms of Website Use, these terms of product purchase ("the Purchase Terms") set out the additional terms and conditions under which you may purchase from Love Shake products appearing on this website. By completing the customer registration process and purchasing products from this website, an agreement exists between you and Love Shake once Love Shake accepts an order. Each accepted order is a separate agreement.

 

Payment

We use PayPal, Stripe (powered by Shopify) and Afterpay for our payment gateway. When paying with PayPal, you can either pay with your credit card or if you have a PayPal account, log in and pay from your PayPal account. You must pay for your products purchased on this website at the time of placing an order. To pay for products with PayPal, you will be transferred to an external site operated by PayPal. You agree that PayPal is responsible for processing and the security of your payment, and you hereby release Love Shake from any liability in relation to such payment. Please refer to PayPal's terms of use for conditions applying to payment processing services. If you pay using Afterpay, the Afterpay prevailing terms and conditions apply. Shipping

Shipping terms including delivery areas, shipping costs and estimated delivery times are contained in Love Shake’s Shipping Policy published on this page, and the Shipping Policy is expressly incorporated in these Purchase Terms. Orders will not be processed for shipping to an address in a suburb not in Love Shake's delivery area.

Returns

Return claims (including for replacement products, refunds or credits) are detailed in Love Shake's Returns & Refunds Policy published on this website, and the Returns Policy is expressly incorporated in these Purchase Terms. Please refer to this policy to determine your entitlement to a return, and the process that you need to follow.

 

 

4. Shipping Policy

At Love Shake, we not only strive to supply the best products in the marketplace but we also strive to ensure that your order reaches you as quickly and efficiently as possible. Our easy online purchasing system ensures your order is delivered to us instantly so we can then process and send to you as soon as possible.

Australian Shipping Fees:

Free shipping on all orders Australia-wide. 

Payment:

You will receive a confirmation email from Love Shake confirming your payment is successful.

Ordering & Delivery:

1. Goods are packed in a safe manner to prevent damage during transport
2. Goods are delivered to all regions of Australia using various transport services as stated above.
3. Orders are dispatched from our office on the Gold Coast, Queensland, Australia on business days only (Mon to Fri -excludes public holidays).
4. If an item is out of stock, and remains unavailable for 48 hours, we will contact you by email.
5. Unfortunately, you are unable to modify your order after it has been successfully received by us.
6. Unfortunately, we are unable to redirect parcels once they have left our fulfilment centre.
7. To assist us getting your order to you as quickly as possible, please include your phone number and a valid email address to help if we need to sort out any issues with your order.

Australian Delivery Time-Frames:

Estimated Delivery Times within Australia (Australia Post guidelines).

Delivery within Sydney Metropolitan Area	3-7 working days
Delivery to Melbourne	3-7 working days
Delivery to Queensland	3-7 working days
Delivery to other capital cities	3-7 working days
To other interstate locations	3-7 working days

Delivery times do not include handling time.

International Delivery:

We currently do not ship internationally.

5. Returns & Refunds

Returning Love Shake products

We will offer a refund, exchange or store credit on damaged products purchased at Love Shake if reported within 12 hours of delivery. If you receive a product that is damaged, please send us a photo of the damaged product to hello@loveshakeaustralia.com.au and we will offer a refund, exchange or store credit. Delivery fee is non-refundable.We recommend returning items through traceable mail, as any returned items that are not received by Love Shake will not be issued a refund. We also recommend that customers ask for proof of postage at the time of posting returned items.

If you input an incorrect shipping address on your order, you must immediately contact us at hello@loveshakeaustralia.com.au to update your shipping address details. If the order has already been processed or shipped by the time we receive your email, it is strictly your responsibility to locate the parcel and to pay any shipping and handling costs to have it re-delivered to you if the parcel is sent back to Love Shake. Love Shake is not liable if the parcel cannot be located and we will not be expected to send out another product to you for free.

If the parcel is sent back to Love Shake and you would like to cancel your order, thus seeking a refund, Love Shake agrees to refund you the total amount paid by you, less the shipping, handling and the re-delivery fee which is set by Australia Post or DHL.

You must present your Love Shake receipt or other adequate proof of purchase.

If you cannot present your Love Shake receipt or other acceptable proof of purchase, Love Shake reserves the right not to offer a refund or exchange.

Where you seek a refund for any item that was purchased as part of a 'deal', Love Shake may refund the price in accordance with deal eligibility. No refund will be given on free items and any refund amount may be recalculated if your return results in deal eligibility no longer being met.

Please allow 5 business days for a refund to be processed from the date that the returned item is received by Love Shake. You will be informed via the email address that is listed on your Love Shake account once this transaction has been processed. Refunds will be issued to the credit card or PayPal account that the payment had originally come from. If this will be an issue for any reason, please be aware that you must contact our customer care team at hello@loveshakeaustralia.com.au prior to returning any items to Love Shake in order to organise alternative arrangements. If this is not done prior to your return being sent back, any issues which may arise with refunds to the original account are completely out of our control and Love Shake will not be held accountable.

Love Shake reserves the right to:

Assess the condition and age of returned goods prior to offering an exchange or refund. This may result in a repair, exchange or refund being refused.

Please note:

• Your original Love Shake receipt is the best form of proof of purchase
• Refunds will be issued using your original payment method

Change of mind purchases:

Love Shake does not offer a refund for change of mind purchase.

 

6. Coupon Codes & Discounts

 

Love Shake at its total discretion may occasionally provide discount coupons to customers.

 

These coupons can only be used towards the payment of Products purchased from our website.

 

Every coupon can only be used once per customer and only one coupon per order will be accepted.

 

Coupon codes are only valid for a single transaction, and may not be used in conjunction with any other discounts we offer.

 

Love Shake will determine the content of Terms and Conditions governing Coupons in its absolute discretion and may amend these at any time.

 

Love Shake reserves the right to withdraw discounts and coupon codes at any time.

 

7. Subscription Contract

 

The Subscription Contract is between you and us.

 

Monthly Subscriptions:

 

By purchasing a Monthly Subscription, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. Your subscription will be automatically extended for successive monthly periods and your payment method will automatically be charged for each successive quarterly period at the then-current subscription rate.

 

To cancel your Subscription, you must log on to your account and follow the cancellation procedures. If you cancel, you may use your subscription until the end of your then-current subscription term. If you’d like to cancel your next order, you must do so prior to the re-billing date. Love Shake may submit periodic charges without further authorisation from you, until you provide prior notice that you have terminated this authorisation or wish to change your payment method. Such notice will not affect charges submitted before Love Shake reasonably could act. We may terminate the agreement at any time at our discretion provided the Customer receives refund for any product paid for but not delivered.
